The United States House of Representatives has successfully passed the bill ‘Clarity Act’ seeking clarity for the creation of non-fungible token-based gaming coins. This highly anticipated bill has proceeded to the Senate. Upon approval, this ‘Clarity Act’ bill will unlock a new era of billion-dollar gaming tokens. At the time of publishing, the chances of this bill passing in the Senate stand at 87% on Polymarket.
The Clarity Act Just Passed In The House Of Reps
In a July 17 blog post, Robbie Fergusson, the Co-founder and President of Immutable, confirmed that the Clarity Act has just passed in the United States House of Representatives and it’s now proceeding to the Senate. The United States House of Representatives is the lower house, with the U.S. Senate being the upper house. Together, the U.S House and Senate have the authority under Article I of the U.S. Constitution to pass or defeat federal legislation.

For too long, the non-fungible token gaming market has lacked a clear regulatory framework, and builders in Web3 Gaming have been operating in a grey zone. The unclear NFT regulation has discouraged many game studios, in particular larger and more mature AAA developers, from launching tokenized in-game assets. Many builders have been second-guessing whether the digital assets that make their games unique, such as skins, cards, and in-game currencies, could be construed as securities.
In response to regulatory uncertainty, the majority of non-fungible token-backed games have found themselves cornered to launch utility-less ‘meme tokens’ before gameplay or in-game utility mechanics were developed out of legal caution. Many blockchain games have simply opted to launch a non-functional “meme” style token rather than risking enforcement. This has resulted in many speculative hype cycles for gaming tokens.
The Clarity Act Is A Game-changer In NFT Gaming
The Clarity Act, formally known as the Digital Asset Market Clarity Act of 2025, is a proposed piece of legislation currently being considered by the U.S. House of Representatives. In concert with other digital asset bills, it offers the most concrete path yet to U.S. digital asset regulation. If approved in the US Senate and assented to by President Trump, the proposed U.S. legislation will be a game changer in the NFT gaming industry.
The proposed sought to exclude video game assets or tokenized in-game assets (NFTs) from the definition of “digital commodities,” providing clearer and better guidance and legal protection for tokenized in-game economies. Even though the proposed framework does not fully exclude a video game asset from being classified as a security or digital commodity, it will depend on the specific characteristics of the video game asset.

If passed in its current form, the Clarity Act 2025 will provide a degree of protection and a much clearer path for developers looking to launch tokenized in-game assets. This means that AAA studios will be able to launch tokenized assets, such as unique items, NFT skins, and player-crafted gear, with much greater upfront certainty as to the status of those assets under the law as opposed to a fear that regulators could come knocking years later with retroactive enforcement.
The Clarity Act Is A Huge Win To Immutable
