The CLARITY Act, the most sweeping crypto regulation bill Congress has ever advanced, is stalled on the Senate floor, blocked not by Republicans but by seven Democrats who say the ethics language written to win their votes is structurally designed to let President Trump walk free.

This latest CLARITY Act news drop comes as BTC USD trades for around $63,500, up roughly +1.5% over the past 24 hours with $25Bn in daily trading volume, up from $21Bn yesterday.

What the Ethics Provision Actually Says

The crypto ethics provision, released as part of the revised 616-page CLARITY Act text on July 22, 2026, by Sen. Cynthia Lummis (R-Wyo.), bars federal public officials and their spouses from issuing or sponsoring a new digital asset while in office.

Platforms are prohibited from listing any asset issued in violation of that rule. Officials with pre-existing crypto holdings can remain compliant by placing those assets in a qualified blind trust or divesting them.

Enforcement authority rests exclusively with the Department of Justice. State attorneys general are explicitly barred from bringing any enforcement actions.

The provision sunsets at noon on January 20, 2029, the final day of Trump’s second term – and prohibits the DOJ from prosecuting violations after that date, even for conduct that occurred while the provision was in force.

Trump’s financial disclosures, released in late June, show more than $1Bn in crypto-related income in 2025, tied to ventures including World Liberty Financial and the TRUMP meme coin.

The Seven Democrats and Their Objections

On July 22, Angela Alsobrooks (D-Md.) and several other Democratic senators criticized the CLARITY Act for falling short in areas like ethics, consumer protection, and market integrity.

At a Semafor event, Alsobrooks specifically objected to the proposed DOJ-only enforcement, calling it “wild and unserious,” while Democrats are advocating for state attorneys general to have enforcement authority, a demand Republicans oppose.

The Democratic concerns include that the provision only affects new crypto issuances, allowing Trump’s existing income streams to remain untouched; the enforcement mechanism grants oversight to a presidentially appointed attorney general.

The provision’s January 20, 2029, sunset effectively grants retroactive immunity after Trump leaves office. Notably, Sen. Kirsten Gillibrand (D-N.Y.), a key negotiator, was absent from the joint statement, and her colleagues’ opposition is significant for Republican counts.

The Procedural Clock Is Running Out

The CLARITY Act passed the House in July 2025 with a 294–134 vote and cleared the Senate Banking Committee with a bipartisan 15–9 vote in May 2026. However, it has not yet appeared on the Senate floor schedule.

Crypto analyst Ted Pillows noted that if the Senate waits until August 6 to file a cloture motion, the earliest vote would be August 8, leaving little time for debate. Chris Barrett from Chainlink mentioned that while a cloture vote this week isn’t ruled out, it hasn’t been scheduled yet.

Analysts from JPMorgan and Bernstein suggest that the chances of passage decrease as the ethics impasse continues, warning that if the CLARITY Act fails, the CFTC and SEC may implement stricter crypto rules.

Sen. Gallego and Sen. Thom Tillis are reportedly working on a counter-proposal regarding the ethics language, which could determine if the CLARITY Act receives a vote before Congress recesses.
