Lummis Sees Vote Nearing After 11 Months of Negotiations

U.S. Senator Cynthia Lummis (R-WY), chair of the Senate digital assets panel, said the Senate could remain in session beyond Friday as lawmakers push to vote on the CLARITY Act before the August recess. Speaking to Fox Business on Aug. 5, she said a vote would put every senator’s position on the record.

With the Senate originally expected to begin its August recess on Friday, Lummis remarked:

“I don’t think we will be leaving on Friday. I think we will go into the weekend.”

The senator attributed the extended schedule to several bills still awaiting votes. “There are other bills in addition to the CLARITY Act that we need to take votes on before we leave for the August recess. CLARITY is one of those bills,” she continued.

The Wyoming lawmaker said 11 months of negotiations produced more than 300 pages of Democratic-requested changes, with talks still ongoing over the Commodity Futures Trading Commission (CFTC) section, law enforcement provisions, and ethics rules for senior federal officials.

She stressed:

“I do believe that we will get a vote on the CLARITY Act and get people on the record.”

Ethics and Enforcement Provisions Shape Final Talks

On Aug. 5, Democratic Senate Banking Committee staff identified five unresolved areas, including securities protections, illicit finance, national security, and presidential conflicts of interest. Their analysis of the bill highlights the key disputes still shaping negotiations.

President Donald Trump received a bipartisan counterproposal that would allow state attorneys general to enforce federal crypto ethics rules. The ethics counteroffer sent to the White House followed talks led by U.S. Senators Thom Tillis (R-NC) and Ruben Gallego (D-AZ).

Lummis noted that Trump had accepted ethics restrictions broader than those imposed on previous presidents, while Democrats sought further safeguards. The proposal remained before him as senators prepared for a vote.

The lawmaker declared:

“We are going to vote on it so it can’t die by no votes. And if it dies, it’s going to be because the Democrats kill it.”

Regulators Back a Federal Crypto Framework

CFTC Chairman Michael S. Selig endorsed congressional action after the Senate Agriculture Committee advanced digital asset market structure legislation on Jan. 29. His statement supporting clearer digital asset rules backed efforts to make the United States a leading financial technology market.

The CLARITY Act would divide oversight between the CFTC and the U.S. Securities and Exchange Commission (SEC), with separate paths for qualifying digital commodities and securities. SEC Chairman Paul Atkins also expressed optimism that Congress will pass the legislation, adding support from another central regulator.

Supporters say defined agency authority would help exchanges, developers, investors, and enforcement officials operate under consistent rules. Lummis argued the framework would keep crypto companies, capital, and innovation in the United States.

She explained:

“We want to onshore this industry. We don’t want it to go to Switzerland or the UAE or Singapore. This is an important industry in the U.S.”

“We’ve tried to find a way to allow innovation to occur while still having a clear regulatory framework that this industry can comply with. And they want to comply. They want to be in the United States. Let’s let them by passing the CLARITY Act,” the lawmaker concluded.

Recess Deadline Raises Pressure

Senator Lummis previously warned that the existing regulatory structure was failing companies, consumers, and law enforcement. Her call for a vote before the recess also emphasized custody rules, disclosures, and federal supervision.

The approaching recess has narrowed the window for securing the 60 votes generally needed to advance major legislation. Republicans hold 53 seats, requiring Democratic support. A Senate vote would place every lawmaker on the record ahead of negotiations with the House over the final legislation.
