CLARITY Act Faces Sept. 15 Senate Procedural Test

Digital asset legislation will return to the center of the Senate agenda as lawmakers prepare for a key procedural step that will decide whether H.R. 3633 moves forward for full debate. The Senate Democrats’ published schedule on Aug. 8 says the cloture motion on the Digital Asset Market Clarity Act can be taken up at 2:15 p.m. on Sept. 15.

Under the announced schedule, senators could take up cloture on whether to move forward with considering Calendar No. 423, H.R. 3633, not on final passage of the bill. A motion to proceed is the procedural step that determines whether the Senate can take up the bill, while cloture is the step that limits debate so the chamber can move ahead.

For legislation, Senate voting procedures generally require three-fifths of senators duly chosen and sworn to invoke cloture, meaning 60 votes in a fully seated Senate. Clearing that threshold would move H.R. 3633 closer to Senate consideration, while failure to invoke cloture would prevent the motion from overcoming the chamber’s extended-debate hurdle at that stage.

McHenry Highlights Senate Floor Time for Crypto Bill

Former U.S. Rep. Patrick McHenry (R-NC) stated on X on Aug. 8 that securing Senate floor time marked an important procedural development for the legislation:

“The Hill, especially the Senate, is driven by the calendar, or ‘floor time’ … The Clarity Act is now on the calendar. Leader John Thune is giving crypto floor time. Though delayed, senators will be on the record.”

A Sept. 15 vote is not guaranteed to occur exactly as currently scheduled. The cloture motion could be withdrawn or vitiated, Senate leaders could reach a unanimous-consent agreement that changes the timing or procedure, or the chamber could take another procedural step before a roll-call vote. If the cloture vote proceeds and succeeds, the Senate would move closer to considering H.R. 3633; if it fails, the motion to proceed would not advance at that stage.

House-Passed Crypto Bill Advances Through Senate

H.R. 3633 would establish a regulatory framework for digital commodities by assigning roles to the Commodity Futures Trading Commission (CFTC) and the U.S. Securities and Exchange Commission (SEC). The bill also establishes requirements covering trade monitoring, recordkeeping, customer asset commingling, alternative trading systems, and provisional registration.

Congressional records show the House passed the measure 294-134 on July 17, 2025, before it was received in the Senate and referred to the Senate Banking, Housing, and Urban Affairs Committee.

Momentum continued this year when the Senate Banking Committee advanced H.R. 3633 by a 15-9 vote on May 14, sending the legislation toward consideration by the full Senate. The Senate Agriculture Committee also advanced the Digital Commodity Intermediaries Act on Jan. 29, a companion market structure measure that builds on the House-passed CLARITY Act and would expand the Commodity Futures Trading Commission’s authority over digital commodities.

The Sept. 15 cloture action follows an Aug. 8 filing on the motion to proceed to H.R. 3633, while the Senate schedule shows lawmakers are scheduled to return for regular business Sept. 14 after a series of pro forma sessions during the summer recess. Political pressure has also increased after U.S. Senator Bernie Moreno said negotiations over the CLARITY Act had ended, shifting attention toward whether supporters can secure enough votes to advance the measure when the Senate reconvenes.
