The Treasury secretary linked the legislation to U.S. leadership and the government’s ability to combat illicit activity involving cryptocurrencies. Bessent stated: “When the Senate returns from August recess, I strongly urge everyone to remain at the negotiating table, agree to the motion to proceed, and continue the legislative process.” The Treasury secretary added:
“Failing to do so would send a troubling signal to our allies and adversaries alike that America is unwilling to lead on the future of digital assets and willing to forgo enhanced national security tools to combat their misuse.”
Republican supporters quickly amplified his position ahead of the scheduled vote. U.S. Senator Cynthia Lummis (R-WY) urged lawmakers to follow Bessent’s recommendation, describing the legislation as bipartisan and arguing that it would protect consumers, assist law enforcement, and keep the growing digital asset industry in the United States.

Cloture on that motion requires 60 votes.
Republicans hold 53 Senate seats, so supporters need at least seven non-Republican votes if every Republican backs the motion. Republican senators have questioned the CLARITY Act’s prospects, pointing to unresolved negotiations over ethics provisions involving a president and immediate family members with digital asset businesses.
The legislation has already passed the House and advanced through the Senate Banking Committee. The committee approved H.R. 3633 by a 15-9 vote in May, with Republicans and two Democrats supporting the measure.

Senate Republicans released revised CLARITY Act language on Sept. 10 as lawmakers sought support before the vote. The proposal would establish regulatory responsibilities for the Securities and Exchange Commission and Commodity Futures Trading Commission while creating requirements for digital asset intermediaries.
