Canadian Banking Regulator Takes A Stance Regarding Tokenized Deposits

The Canadian financial system has received good news regarding the possible integration of decentralized technologies in its banking ecosystem.

On Thursday, the Office of the Superintendent of Financial Institutions (OSFI), the Canadian banking regulator that supervises nearly 350 financial institutions and 1,200 pension plans, took a friendly stance on tokenized deposits, which are digital representations of actual deposits that can be moved onto public decentralized rails depending on their specific implementation.

While controversial for some, the regulator clarified its technology-neutral position on these structures, stressing that “the underlying technology of a financial product or service does not determine its legal nature.”

“To be clear, we focus on what the product or service is, not how it is built or delivered. Tokenized deposits are, for example, not legally distinct from traditional deposits,” it stressed, binding products that use this technology to the current regulatory framework and avoiding the need for enacting additional regulation to oversee these operations.

Even so, the regulator stressed that as builders of products and services operating in the Canadian financial ecosystem, financial institutions are responsible for ensuring compliance of these innovative activities with applicable laws and regulations, including those performed by a third party on their behalf.

The OSFI concluded that financial institutions were “expected to engage with their OSFI lead supervisors in advance of launching any novel products or services,” encouraging them to seek legal counsel before launching any of these products.

With this statement, the OSFI recognizes the relevance of digital advances in the financial field, acknowledging that this represents “a specific use case where additional clarity from OSFI on legal permissibility could be beneficial”.

This paves the way for banks and other financial institutions to cautiously begin implementing tokenized deposits on their platforms, taking advantage of the benefits they offer and lifting the compliance burden for these products in a nation where there is considerable interest in offering crypto services.
